Terms of Service for TubigPadala

1. Acceptance of Terms

By accessing or using TubigPadala, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.

2. Service Description

TubigPadala connects customers with local water suppliers for delivery of purified and alkaline drinking water. We are a platform only - we do not own or operate water delivery services.

3. User Accounts

3.1 Registration

• You must provide accurate phone number, name, and address
• You must be 18 years or older to use TubigPadala
• One account per phone number
• You are responsible for keeping your account secure

3.2 Account Termination

We may suspend or terminate accounts that:

• Violate these terms
• Abuse suppliers or the platform
• Provide false information
• Engage in fraudulent activity

4. Orders and Payments

4.1 Placing Orders

• All orders are cash on delivery (COD)
• Prices are set by suppliers, not TubigPadala
• Orders are final once accepted by supplier
• Delivery times are estimated, not guaranteed

4.2 Cancellations

• Customers can cancel pending orders before supplier acceptance
• Once accepted, contact supplier directly to cancel
• Suppliers may charge cancellation fees for prepared orders

4.3 Payment Status ("Utang")

• Mark payment as "paid" or "unpaid" on delivery
• Unpaid orders tracked as "utang" (debt)
• You must settle unpaid balances with suppliers
• Excessive unpaid orders may result in service suspension

4.4 Delivery Proof

• Suppliers may take photos as proof of delivery
• Photos used for dispute resolution only
• 3 failed delivery attempts = order auto-cancelled

5. User Responsibilities

5.1 Customers Must:

• Provide accurate delivery address
• Be available at delivery time
• Pay correct amount in cash
• Treat suppliers with respect
• Settle unpaid balances promptly

5.2 Suppliers Must:

• Deliver clean, safe drinking water
• Respond to orders within reasonable time
• Update order status accurately
• Treat customers with respect
• Maintain accurate payment records

6. Prohibited Activities

You may not:

• Use the app for illegal purposes
• Harass or threaten other users
• Interfere with app functionality
• Create multiple accounts to abuse the system
• Share false delivery addresses repeatedly
• Refuse payment for delivered orders

7. Platform Role and Liability

7.1 We Are a Platform

• TubigPadala connects customers and suppliers only
• We do not produce, sell, or deliver water
• We do not guarantee water quality or delivery times

7.2 Limitation of Liability

TubigPadala is not liable for:

• Water quality issues (contact supplier directly)
• Late or failed deliveries
• Disputes between customers and suppliers
• Lost or stolen cash payments
• Unpaid debt collection

7.3 Dispute Resolution

• Delivery disputes: Contact supplier first
• If unresolved: Contact TubigPadala support
• Delivery photos used as evidence
• Final decision at TubigPadala's discretion

8. Service Fees

• TubigPadala charges suppliers a small commission per order
• Customers pay no service fees (currently)
• We may introduce customer fees with 30 days notice

9. Intellectual Property

• TubigPadala name, logo, and app design are our property
• You may not copy, modify, or distribute the app
• Delivery photos belong to TubigPadala and suppliers

10. Privacy

Your privacy is important. See our Privacy Policy for details on data collection and use.

11. Push Notifications

• We send order status updates via push notifications
• You can disable notifications in device settings
• Critical order updates may still be sent via SMS

12. App Updates

• We may update the app to fix bugs or add features
• Updates may be required for continued use
• We are not liable for issues with outdated versions

13. Termination

• You may delete your account anytime
• We may terminate service for terms violations
• Order history may be retained for business records

14. Changes to Terms

We may update these Terms. You will be notified in-app. Continued use means acceptance of changes.

15. Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Disputes will be resolved in Calabarzon courts.
